These terms cover your use of Photism, whether you bought the full version, downloaded Photism Lite for free, or ran Photism Online in your browser. Photism is made and sold by Cerrone LLC, a Colorado limited liability company doing business as Photism. "We" in these terms means Cerrone LLC. By buying or using Photism you agree to these terms. If you do not agree, do not use the product, and use the refund policy if you have already bought it.
Your download also includes a LICENSE file that covers the software itself. It says the same things as this page. If the two ever disagree, this page is the current version.
What you are buying
Photism is an audio-reactive visualizer that ships as a VST3/AU plugin, a standalone app, a Max for Live device for Ableton, and a browser app. Your purchase is a one-time payment for a personal license to use Photism, and it covers every format. It includes free updates through the v1.x series, delivered as a new download.
Your license
You may use Photism for your own work, personal and commercial, including live performance, recorded video, and released content. You may install it on the computers you personally use.
You may not resell, rent, sublicense, or redistribute the Photism device and renderer files, or share them so others can use Photism without buying it. Photism does not lock the files down with copy protection. It is sold on trust: if you find it useful, the fair thing is for each person using it to buy their own copy.
Requirements
Photism runs on macOS and Windows. To use the plugin you need any DAW that hosts VST3 or Audio Unit, or you can run the standalone app with no DAW. To use the Max for Live device you need Ableton Live Suite, or Ableton Live Standard with the Max for Live add-on. All formats require a reasonably modern GPU. Please confirm your setup meets these requirements before buying. The refund policy is there if it does not work for you.
Flashing lights and photosensitivity
Photism produces bright, fast, flashing visuals. Flashing light and high-contrast moving patterns can trigger seizures in people with photosensitive epilepsy, including people who have never had a seizure before. Photism does not limit its own flash rate and is not tested against any flash-safety standard.
If you show Photism to other people, whether at a venue, a stream, or a private event, it is your responsibility to warn your audience that the show includes flashing lights, and to follow whatever rules your venue or platform has. The device gives you live controls to reduce flashing (HEAT, REACT, and BRIGHT down; TRAILS up), and section 21 of the manual explains how to use them. Stop the visuals and get medical help if anyone watching becomes unwell.
Open-source components
Photism bundles third-party open-source software (including three.js, lil-gui, and FFmpeg). Each keeps its own license, and those licenses are reproduced in the THIRD-PARTY-NOTICES file included in your download. Those components are governed by their own terms, not by this license.
No warranty
Photism is provided "as is," without warranties of any kind, express or implied. We do not guarantee it will be uninterrupted or error-free, or that it will fit every system or use case.
Limitation of liability
To the fullest extent allowed by law, Cerrone LLC is not liable for any indirect, incidental, special, or consequential damages, or for lost data, lost work, lost profits, or interrupted performances, arising from your use of, or inability to use, the product. To the fullest extent allowed by law, our total liability for any claim is limited to the amount you paid for Photism, which is nothing if you are using Photism Lite or Photism Online.
Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. Nothing here removes rights you have under mandatory consumer-protection laws in your own country.
